General information
The Rail Market Regulatory Agency was established by the Act on Rail Market Regulatory Agency (Official Gazette of the Republic of Croatia, No. 79/07). It resolves disputes concerning the application of the Railway Act, particularly in the part related to the performance of rail transport activities, with the aim of securing non-discriminatory and fair market conditions. The Agency performs its controlling function through the appeal procedure by acting in disputes concerning the rights and duties on the rail services market.
The Agency is established as an independent regulatory body that is autonomous and objective in decision-making.
Those decisions are brought by the Administrative Board consisted of the chairperson and two members. They are nominated by the Government of the Republic of Croatia and appointed by the Parliament of the Republic of Croatia on a 5 year term. The Agency is registered at the Commercial Court in Zagreb.
On 15 June 2009, the Parliament of the Republic of Croatia brought the Decision on the appointment of the chairperson and members of the Administrative Board of the Rail Market Regulatory Agency (Official Gazette, No. 69/2009), thus ensuring the preconditions for the constitution and operation of the Agency.
The Administrative Board was constituted on 1 July 2009. It adopted the Agency's Statute on the same day and submitted it for approval to the Government of the Republic of Croatia. With the adoption of the Statute, the Agency became operational.
